Factual reporting, interpretation and distortion Essay How are distinctions made between factual reporting, interpretation and distortion? This essay is going to tell the differences between factual reporting, interpretation and distortion. Factual reporting means that an answer or a statement is based on facts that are true and proven. Interpretation is an individuals opinion and appreciation about a subject. It is not based on facts but just on opinions and theories. Distortion is a way of delivering wrong information, twisted and wrongly explained information. It is based on facts but kind of turns them around. Factual reporting is the way of delivering an opinion/theory based on true facts. An example of this is an article I read in Metro today, which was about conspiracies. The one that caught my eye was one that stated that an airplane never crashed into the Pentagon. This theory was based on facts, which I never had heard of. For example, the surveillance camera of the Pentagon didnt show an airplane but only a white line in the sky. Another thing was that the hole in the Pentagon was way too small to have been creased by an airplane. The write stated that the US Air force shot down flight 77, and to cover this up they blew up a part of the building without the workers knowing anything about it. Also no big wreck parts from the plane were found. This is a factual reporting as its based on true facts and it not created by opinions or own thoughts as in an interpretation. Also the moon landing is believed to be a fake. There are many facts that point against it. In a video from the moon the flag that Neil Armstrong put up was waving in the wind. And theres not supposed to be any wind on the moon. Also the shadows go in different directions and the shadow of the space shuttle should fall on Armstrong, a good example of factual reporting. A theory based on facts. Interpretation is a theory based an individuals own opinion. A great example of this is racists. The Nazis believe that black or people with darker skin than westerners are worth less. This is a great example as this theory of theirs is based on their own opinions and have no actual facts to base it on. There is no proof that colored people are worth less than white people. This is why its an interpretation. No facts or proof are involved in the theory. Another example of interpretation is Bin Ladin. The US government doesnt know that hes alive. The videos that they got from him are old now and he could be dead already. The US government think that he is alive because of the videos, but they have been bombing caves, cities and other places in hope of killing him, so he could be dead. This is interpretation as they base it on what they believe. There is no proof that hes alive. Distortion is when facts are wrong, twisted or inaccurate. Another definition is when two people disagree with one another. An example is if I say to Andreas, we have homework for tomorrow and he says we dont. This is distortion in a way. Another example is all kinds of magazines and television shows as they tent not to show all of their footage information. They cut what they dont want people to hear, which helps them things look negative and positive. This is a typical example of distortion as it twists the truth or the reality. Often when you experience something and they write about it the next day in a newspaper, its never the same. You always say to yourself, Thats not exactly what happened. Sometimes the media exaggerate to find a big audience. They do what I like to call, Stretch reality. Its a clear case of distortion because they twist the truth or give an inaccurate point of view. As a conclusion or to answer the question I would like to say that the difference or the distinctions between factual reporting, interpretation and distortion is the amount of facts they are based on. Factual reporting is based on only facts to make a clear image of a theory, event or opinion. Interpretation is based on opinions but no facts. Only the people who made the theory, its only based on things that are going on inside those peoples heads. Distortion is based on facts but mostly told the opposite way or twisted to change the way people think of it. It often tries to make the facts inaccurate.

Ginsberg and Roth Choosing Their Own Judaism      Ã‚  Ã‚   I take these things for granted. Tradition and cultural awareness to me is another thing I can shrug off like too much homework. To my generation it's fashionable to embrace other traditions: mendhi tattoos for the Italians, matzo ball soup for the Pakistanis, McDonald's for the Nigerians. When did we learn to borrow from everyone else? When did I learn to come to terms with my own identity? The Civil Rights movement started it all. In quick succession, Asians demanded recognition, Native Americans wanted to carve a place back into their country, women wanted to burn their bras. Why not the Jews in America? Allen Ginsberg used his own tradition and his mother's death to establish that identity, while Philip Roth used a fictional narrative to tell the story of a Jewish family in America. Why compare these works at all? Both are creative accounts of Jewish American culture, one through poetry and one through a fictionalized self. Both use Judaism to express feeling to eith er tradition or memory. Both are literary works in the 1960s that deal with Jewish self-identity rather than black, white, or other identities. But I'm getting ahead of myself... Allen Ginsberg says his own work "Kaddish" is "finally, completely free composition, the long line breaking up within itself into short staccato breath units - notations of one spontaneous phrase after another..." (Allen 417). "Kaddish" is a prayer of atonement, making its point through rhythm, repetition and incantation. Ginsberg uses "Kaddish" to express his understanding of his own identity, and also to put that identity into the framework of Judaism. Ginsberg's mother Naomi went through a series of mental hospitals and psychological outbreaks from Ginsberg's childhood, eventually receiving a lobotomy and dying shortly thereafter. The Ginsberg family never held a traditional "Kaddish" because too few men were present to do so. Two years later, Ginsberg performed the ceremony with then friend Zev Putterman, and later wrote his own version of "Kaddish" (Asher). He starts his "Kaddish" incanting the spirit of Naomi by pulling up memories of her and her identity. "I walk toward the / Lower East Side - where you walked fifty years ago, little / girl - from Russia, eating the first poisonous tomatoes of / America - frightened on the dock" (Allen 195). In Part IV, Ginsberg then goes on to chant to his mother with the phrases "O mother," "with your," and "with your eyes.

Differences and Similarities of Christianity and Judaism Essay

Many people today still believe that Christianity and Judaism are both the same religion. This is not so, despite the fact that they both share certain similarities; Christianity and Judaism are both different religions. It is my pleasure to shed some light on the differences and similarities of both religions’ views on salvation. In this research I will first define salvation in its literal form. Secondly, I will take a closer look into the history and development of both religions and shed further light on how they differ. Finally, I will go on to further compare and contrast both religions and show where they differ and where they are alike. At the end of this research, people will have a greater understanding of both Christianity and Judaism and be able to identify how different they both are. According to Matt Slick, â€Å"Salvation is being saved from the righteous judgment of God upon the sinner.† Most people in the world believe that salvation means being saved from the devil or from themselves, but this is not a fact. Your salvation depends on the judgment God has on you. All who sin against God falls under his judgment, this judgment is known as damnation, and this is where God condemns to eternal hell anyone who has offended him by breaking his law. Matt Slick went further to say, â€Å"This does not mean that God is unfair. It shows that God is holy. God must punish the sinner. But, he has provided a way of escape so that people will not face his righteous judgment. This means that God is both holy and loving. He must manifest each quality equally. So being saved from the wrath of God is called salvation.† The bible states that salvation is found in Jesus and only in him, who is also known as God in flesh and also who died for our sins and rose from t he dead. 1 Cor. 15: 1-4 says, â€Å"Now I make known to you, brethren, the gospel which I preached to you, which also you received in which also you stand, by which also you are saved, if you hold fast the word I preached to you, unless you believe in vain. For delivered to you as of first importance what I also received, that Christ died for our sins according to the scriptures, and that he was buried, and that he was raised on the third day according to the Scriptures.† All of us have sinned against God and deserve judgment. But Jesus never  sinned ( 1 Pet. 2:22). It is through Jesus we all gain salvation based on evidence in the scriptures and this is how salvation works. To define it simply, Christianity is one of the world’s major monotheistic religions. Christians believe in Jesus Christ and follow his teachings. they believe Jesus is God’s own son, sent by God to become human. As the son of God, Jesus is divine, but he was also a human being who lived among us on earth, over 2,000 years ago. Followers of Jesus are part of God’s people, whose heritage includes the Jewish people and the Christian Church throughout the world today. Christianity strongly supports salvation and everything it stands for. According to Patheos Library, an online religious community, â€Å"Christianity developed out of Judaism in the 1st century C.E. It is formed on the life, teachings, death, and resurrection of Jesus Christ, and those who follow him are called Christians.† Christianity’s origin came out of Palestine and they believe in God (Trinity), which means God in three forms, Father, Son, and Holy Spirit. The publication posted on Patheos Library went further to state, â€Å"Christianity has many different branches and forms with accompanying variety in beliefs and practices. The three major branches of Christianity are Roman Catholicism, Eastern Orthodoxy, and Protestantism, with numerous subcategories within each of these branches.† It was not until the latter part of the 20th century that most adherents of Christianity were in the west, even though it had spread to every continent and is now the largest religion in the world today. The traditional Christian beliefs include the belief in the one and only true god, who is one being and exist as Father, Son, and Holy Spirit. Christianity also believes in Jesus as the divine and human Messiah who was sent here on earth to live and dwell with man and save the world from sin. The Christian church has many ethics that governs the activities of the church and aid in ensuring that its members walk in the correct path and grows closer in faith and closer to God. The Christian church ethics stands firm against abortion and believes this practice is of the devil. Christianity also disagrees with same sex marriage as well, based on the fact that in creation, God made Adam and Eve, not Adam and Steve. This has been a very controversial topic for many years, as many do believe that same  sex marriage should be accepted as human rights activist backs up this claim. There has been not one case in the bible where same sex marriage or same sex relationships were encouraged or practiced freely, and it’s based on this that Christians do not believe in the practice. A brief look into the culture of Judaism should shed some light on the culture and help persons to differentiate better. According to, thinkquest.org, â€Å"Judaism is the religious culture of the Jewish People and is one of the world’s oldest religions. Judaism makes up the cultural system of Jewish law, custom, and practice of the whole individual and community. It is a system in which everyone is under God’s rule. Judaism originated in the Middle East and has spread throughout all parts of the world because of both voluntary migrations and forced exile or expulsions. The total world Jewish population is about 15 million, most of whom live in the United States, Israel, and the former Union of Soviet Socialist Republic.† A very important topic when discussing faith in Jewish text is that of Romans in the New Testament. A 20th century western definition of faith is often used to support theologies that claim to be based on the Hebrew Scriptures. For instance, within modern Christianity there is a range of belief regarding faith. The idea that faith is totally separated from â€Å"works† based on verses such as Ephesians 2:8-9 and Romans 3:28 and others taught by some protestants. Also the idea that works must be performed to â€Å"earn salvation.† According to, yashanet.com, an online publication, â€Å"When dealing with the texts of the â€Å"New Testament,† the English language word â€Å"faith† must be interpreted in the Hebrew context it was originally conceived in by the author. As such, the word â€Å"trust† may be a better one to use, at it conveys a combination of belief and action.† The Jewish view of faith, including that of Paul, is established in ideas such as, â€Å"Faith is active and includes the â€Å"works† of following Torah. The foundational statement of faith in Judaism is the â€Å"Shema,† from Deuteronomy 6:4. The term â€Å"hear† (as in â€Å"Hear O Israel †¦Ã¢â‚¬ , means t_o hear and respond obediently._ Faith and obedience are  woven together. This is clearly reflected in the words of Yeshua, Paul and James.† According to, Ariela Pelaia, â€Å"Judaism is a monotheistic faith, meaning that Jews believe there is only One God. Often this God is beyond our ability to comprehend, but God is nevertheless present in our everyday lives. How individual Jews choose to understand this manifestation of the divine varies. Some connect with God through prayer, others see the divine in the majesty of the natural world, others may not think about God on a daily basis. Each individual’s relationship with God is unique and personal.† The Jewish religion teaches that everyone, whether Jewish or non-Jewish, is created â€Å"b’tzelem Elohim,† which is Hebrew for â€Å"in the image of God.† It is with this reason every person is equally important and has an infinite potential to do good in the world. The Jewish community also believes that Jews are uniquely connected with each other, regardless of where they live in this world. The Torah is Judaism’s most important text. It contains stories and commandments that teach us about life and death. It contains the 10 Commandments as well as the 613 commandments (mitzvot). All Jews consider the 10 Commandments to be the most important commandments in the Torah, though not all Jews adhere to the 613 mitzvot (one of the main differences between the different branches of Judaism). The Torah also tells us that the Land of Israel (Eretz Yisrael) was apart of the covenant made between God and the Jewish people on Mount Sinai. Even though Judaism and Christianity have a lot in common, they do both share some major differences that clearly set them apart. Traditionally, Jews recite prayers three times daily, with a fourth prayer added on Shabbat and holidays. Most of the prayers in a traditional Jewish service can be said in solitary prayer, although communal prayer is preferred. Jews also have certain religious clothing which a traditional Jew wears. Christians believe that all people should strive to follow Christ’s commands and example in their everyday actions. For many, this includes obedience to the Ten Commandments. Other Christian practices include acts of piety such as prayer and Bible reading. Christians assemble for communal worship on Sunday, the day of the resurrection, though other liturgical practices often occur outside this setting. Scripture readings are drawn from the Old and New  Testaments, but especially the Gospels. The place of origin for Christianity is Jerusalem while Judaism reigns from out of Israel and Christianity believes in Jesus Christ as founder and messiah, and for Judaism its Abraham, Moses. Christian practices includes, Prayers, Sacraments, worshipping in Church, reading the Holy Bible, acts of charity, Communion-partaking in the Body and Blood of Our Lord Jesus Christ, under the appearance of Bread and Wine. The practices of Judaism differs in that, Orthodox Jews recite prayers 3 times daily, with a fourth prayer added on Shabbat and holidays. Shacarit prayer in the morning, Mincha in the afternoon, Arvit at night. Musaf is an extra Shabbat service. When it comes down to the source of scripture, Christianity uses the Holy Bible, a collection of canonical books in two parts (Old and New Testament). For Judaism it’s the Tanakh (Jewish Bible), Torah. When it comes down to life after death, the Christian view of this is that Man is appointed to die once, and after that come judgment. In this Act, unless there is anything repugnant in the subject or context, ‘adolescent’ means a person who has completed sixteen years but has not completed eighteen years of age,’adult’ means a person who has completed eighteen years of age, ‘child’ means a person who has not completed sixteen years of age,’day’ means a period of twenty-four hours beginning at mid-night, ‘explosive substance’ includes any materials for making any explosive substance; ‘factory’ means any premises including the precincts thereof whereon ten or more workers are working or were working on any day of the preceding twelve months and in any part of which a manufacturing process is being carried on with or without the aid of power, but does not include a mine subject to the operation of the Mines Act. Power to apply the provisions of this Act to certain places. – (1) The Government may, by notification in the official Gazette, declare that all or any of the provisions of this Act shall apply to any place wherein a manufacturing process is being carried on or is ordinarily carried on whether with or without the use of power whenever five or more workers are working therein or have worked therein on any day of the twelve months immediately preceding. (2) A notification under sub-section (1) may be made in respect of any one such place or in respect of any class of such places or generally in respect of all such places. 3) Notwithstanding anything contained in clause (f) of Section 2, a place to which all or any of the provisions of this Act are, for the time being, applicable in pursuance of a declaration under sub-section (l), shall, to the extent to which such provisions are so made applicable but not otherwise, be deemed to be a factory. Section 4. Power to declare departm ents to be separate factories. The Government may, by order in writing, direct that the different departments or branches of a specified factory be treated as separate factories for all or any of the purposes of this Act. Section 5. Power to exempt. – The Government may, by notification in the official Gazette, exempt any factory or any class or description of factories from all or any of the provisions of this Act for such period as it may think fit in the public interest: Provided that no such exemption shall be made for a period exceeding six months at a time. Section 6. Notice to Inspector before commencement of work. – (1) The occupier shall, at least fifteen days before he begins to occupy or use any premises as a factory send to the Chief Inspector a written notice containing the name and situation of the factory,the name and address of the occupier, the address to which communications relating to the factory may be sent,the nature of the manufacturing process – (2) In respect of all factories which come within the scope of this Act for the first time, the occupier shall send a written notice to the Chief Inspector containing particulars specified in sub-section (1) within thirty days from the date of the commencement of this Act.. 3) Before a factory engaged in a manufacturing process, which is ordinarily carried on for less than one hundred and eighty working days in the year, resumes working, the occupier shall send a written notice to the Chief Inspector containing the particulars specified in sub-section (1) within thirty days before the date of the commencement of work. Whenever another person is appointed as Manager, the occupier shall send to the Chief Inspector a written notice of the change, within seven days from the date on which such person assumes charge. (5) During any period for which no person has been designated as Manager of the factory or during which the person so designated does not manage the factory, any person found acting as Manager or if no such person is found, the occupier himself shall be deemed to be the Manager of the factory for the purposes of this Act. Section 7. Seasonal Factory. – The Government may, by notification in the official Gazette, declare any factory in which manufacturing processes are ordinarily carried on for not more than one hundred and eighty working days in the year and cannot be carried on except during particular seasons or at times dependent on the irregular action of natural forces, to be a seasonal factory for the purposes of this Act. Section 8. Approval of plans and fees for licensing and registration. – (1) The Government may require that previous permission in writing be obtained in the prescribed manner from the Chief Inspector for the construction or extension of any factory or class or description of factories, require registration and licensing of factories or any class or description of factories and payment of fees for such registration and licensing or for the renewal of licences, in the prescribed manner. If, in accordance with the provisions of sub-section (1) an application for permission accompanied by the plans and specifications is sent to the Chief Inspector and no order is communicated to the applicant within two months from the date of its receipt by the Chief Inspector, the permission applied for in the said application shall be deemed to have been granted. (3) Where the Chief Inspector refuses to grant permission to the said construction or extension of a factory or to registration and licensing of a factory the applicant may, within sixty days of the date of such refusal, appeal to the Government.

Judicial Precedent A Practice Of The Courts Law Essay Judicial precedent: Where past decisions of judges are followed in future cases when the facts of the cases are similar. Once a judge decides a legal principle, it is required that is used in future legal cases with similar issues or facts. This is also known as case law or common law which has developed by broadening down from precedent to precedent. Therefore the legal definition of Judicial precedent can be stated as a courts judgment quoted as an authority for deciding a similar set of facts; a case which serves as authority for the legal principle established in its judgement. It refers to the way in which the law is made and amended through the decisions of judges. Thus, judicial precedent is based on the judges judgement, hierarchy of courts and a good system of law reporting judges. The judicial precedents doctrine is based on the stare decisis principle to stand upon decisions and by which precedents are authoritative and binding and must be followed. In practice, this means that lower courts are bound to apply the legal principles set down by superior courts in earlier cases. This provides balance and certainty in the law. A precedent is always based upon the two factors the ratio decidendi which means a reason for the decision and obiter dictum which means something said by the way and also the decisions made in the previous relevant cases. The ratio decidendi of a case is the important part of establishing precedents that binds inferior courts in the hierarchy. When a judge makes his judgement in a case, he outlines the facts which he finds have been proved on the evidence. Then he applies the law to those facts and reaches at a decision, for which he gives the reason (ratio decidendi). Whereas obiter dictum is a decision given by a judge that has only incidental bearing on the case in question and is therefore not binding in later cases. The decision of the judge may vary according to the facts of the case and is not strictly relevant to the matter in the issue in the original case. The ratio decidendi is the binding part of a judicial decision whereas an obiter dictum isnt. Though, an obiter dictum may be of persuasive (as opposed to binding) authority in later cases. Even if any difficulty arises, the judge will give reasons for his decision, however he will not always tell what the ratio decidendi of case is, and it is then up to a later judge to figure out (elicit) the ratio of the case. However, there may be disagreement over what the ratio is and there may be more than one ratio. Thus, it is not always easy to distinguish ratio decidendi from obiter dictum when evaluating the effects of a particular decision however; when judicial precedent is used, the judge follows or takes the reference of a decision made in a similar past cases that has already been judged upon and he is ruling the same way using the other case as a guideline. Whereas whilst setting judicial precedent the judge renders a decision in a case of a type that had never been tried, or ruled upon in the past, which is completely new, and that his verdict would set the precedent by which all future cases might be judged. Judges, by the way, are not always required to follow prece dent in making rulings. Therefore law reporting, hierarchy of courts and a method of distinguishing between obiter dicta ratio decidendi are considered to be the key features of judicial precedent. The general rule of the precedent is that all courts are bound to follow decisions made by their superior courts and appellate courts are usually bound by their own previous decisions. Any decision made by a superior court is utterly binding on subsequent inferior courts. However, certain of the superior courts consider themselves as bound by their own decisions whilst others dont. Until 1966 The House of Lords was bound by its own previous decisions when Lord Gardiner LC announced a change of practice. The Practice Statement [1966] 1 WLR 1234 stated that even though the House of Lords would treat its decisions as normally binding, it would move off from these when it appeared right to do so. This power has been used carefully. A decision of the House of Lords binds all lower courts but does not regard itself as strictly bound by its previous decisions, for example, in Murphy v Brentwood District Council (1990) the House overruled its earlier decision in Anns v London Borough of Merton (1978) on the issue of a local authoritys liability in negligence to prospect purchasers of property. The Court of Appeal is bound by decisions of the House of Lords although it considers them to be wrong. However in Young v Bristol Aeroplane Co Ltd [1944] KB 718, the Court of Appeal held that it was bound by its own previous decisions subject to the following three exceptions: i. If there is conflict between own previous decisions, the Court of Appeal must decide which is to be followed and which is to be rejected. ii. The Court of Appeal must not follow its own decision which cannot stand with a decision of the House of Lords even if its decision hasnt been expressly overruled by the House of Lords. iii. The Court of Appeal need not to follow its own decision if satisfied that it was given per incuriam (literally, by carelessness or mistake). The High Court and the county courts are bound by the decisions of the court of appeal. Principally there is no difference in the application of stare decisis in the civil and criminal divisions of the Court of Appeal. In practice, in addition to the Young exceptions, because a persons liberty may be at stake, precedent is not followed as strictly in the criminal division however judges tend to follow the decisions of the high court for the sake of certainty. For example R v Taylor [1950] 2 KB 368. The High Court is bound by the decisions of Court of Appeal and the House of Lords however it is not bound by other High Court decisions. The county courts are bound by the decisions of individual high courts. House of Lords and the Court of Appeal binds Divisional Court and normally follows a previous decision of another Divisional Court but if they believe that the previous decision was wrong, they may depart. For eg. R v Greater Manchester Coroner, ex parte Tal [1985] QB 67. The Crown Court judgements are not binding, though they are of persuasive authority. Therefore, Crown Court judges are not obliged to follow them. The decisions made by the judges of county courts and magistrates courts are not binding. They are not usually reported in the law reports as they are rarely important. Judicial precedent is one of the most important source of English law. An original precedent created and applied a new rule whereas the later decisions, of the higher courts, can have a number of effects upon precedents. Particularly they may be: Reversed: where on appeal in the same case the decision is reversed and the appeal court substitute its own decision. Overruled: Overruling can occur if the previous court fail to apply law correctly, or because the later court considers that the rule of law contained in the previous ratio decidendi is no longer desirable. then a higher court can overrule a decision made in an earlier case by a lower court. For example, the Court of Appeal can overrule an earlier High Court decision. A refusal to follow: the court may refuse to follow the earlier decision especially when it is not bound by the decision or can not overrule it but does not wish to follow it. Distinguished: where an earlier case is rejected as authority, either because the different material facts or because the statement of law in the previous case is too narrow to be properly applied to the new set of facts. Explained: a judge may seek to study or discuss an earlier decision before applying it or distinguishing it, thus the impact of the earlier case is varied in the circumstances of the present case. A decision which is reached per incuriam is one reached by carelessness or mistake, and can be avoided. In Morelle v Wakeling [1955] 2 QB 379 Lord Evershed MR stated that the only case in which decisions should be held to have been given per incuriam are those of decisions given in ignorance or forgetfulness of some inconsistent statutory provision or of some authority binding on the court concerned. In Secretary of State for Trade and Industry v Desai (1991) The Times 5 December, Scott LJ said that to come within the category of per incuriam it must be shown that the decision involved some manifest slip or error but also that to leave the decision standing would be likely, inter alia, to produce serious inconvenience in the administration of justice or significant injustice to citizens. However, this rule does not permit the Court of Appeal to ignore decisions of the House of Lords. In Cassell v Broome [1972] AC 1027 Lord Denning MR held the House of Lords decision in Rookes v Barnard [1964] AC 1129 to be per incuriam on the basis that it ignored previous House of Lords decisions. He was rebuked sternly by the House of Lords who considered that the Court of Appeal really only meant that it did not agree with the earlier decision: Even if this is not so, it is not open to the Court of Appeal to give gratuitous advice to judges of first instance to ignore decisions of the House of Lords. (Lord Hailsham) There are three types of Precedent, Original, Binding and Persuasive. Precedent can be used instead of statutory law in civil cases. Precedent is also known as a common-law, whereby judges follow the outcome. Original Precedent: If the point of law is absolutely new and has never been decided before, the decision then judge comes to will form a new precedent for subsequent cases. These cases are persuasive but not binding on the court. For eg, if a person commits murder and there are circumstances whereby the judge ruled that this person is not guilty, then a case in equal standing or the case having the same circumstances, in a later ruling can use the precedent to find the person not guilty. Persuasive Precedent: A persuasive precedent is not completely binding on a court but may be applied. The examples can be given as: a. Decisions of English courts lower in the hierarchy. For eg, the House of Lords may follow a Court of Appeal decision, and the Court of appeal may follow a High Court decision, even though not strictly bound to do so. b. Decisions made by the Judicial Committee of the Privy Council. c. Decisions made in the courts in Scotland, Ireland, the Commonwealth (especially Australia, Canada and New Zealand), and the USA. These decisions are usually cited specially where there is a shortage or absolute lack of English authority on a point. d. Obiter dicta of English judges. Judges use a tool called Distinguishing to avoid following a previous decision which they would otherwise be bound to follow. Distinguishing helps to keep judicial precedent and the law flexible. Where a judge founds that the material facts of the present case to be considerably different from the earlier case, then he may distinguish both d cases and refuse to follow earlier decision. There are a number of ways to avoid precedents and this enables the system to change and to adapt to new situations. * Judicial precedent is practical in nature. It is based on real facts, unlike legislation. * Judicial precedent is detailed. There is a wealth of cases to which to refer. To keep your balance, you must keep moving.† Before you learn to ride in a bicycle, you must get hurt first but it doesn’t mean you’ll stop doing it because hurt can make you stronger and braver. The two wheel represent your life, sometimes your up, sometimes your down. Always remember that those wheel has no edges, means you must keep going even if your on the road that full of stones. Stones represent challenges; you must be brave and have trust in yourself. That is life, in every disappointment you’ll get and every happiness you’ll take, you must keep moving. Just like when my innocent’s lost, I’m slowly facing the real meaning of life. Way back when I’m inside my mothers’ womb. I’m naive, unfleshed and my body and my soul covers innocence. You always look like a mess after playing outside the street, you don’t care how your dress smells. It seems like everyday in your life feels perfectly. Because of environment I’m living today, I found new friends and bestfriends. We forgot each other. They all still together but me and my sister separates between our friendship. This is life so we must accept all changes. When I was 10 years of age, my eyes and my mind opened in the unfairness of life. I saw how my mother felt broken and devastated when my father cheated on her two times. I saw her how she cries a lot. How my grandmother in Manila discriminates us when we was younger. â€Å"Who's Celia?† Bonnie said indignantly, as soon as they'd wiped off the blood. She'd put the rose down careful y in the middle of the front seat, between her and Matt, and they were al very consciously not touching it. Pretty as it was, it looked more sinister than beautiful now, Stefan thought grimly. â€Å"Celia Connor,† Meredith said sharply. â€Å"Dr. Celia Connor. You saw her in a vision once, Bonnie. The forensic anthropologist.† â€Å"The one who's working with Alaric?† Bonnie said. â€Å"But why would her name show up in blood on my arm? In blood.† â€Å"That's what I'd like to know,† Meredith said, frowning. â€Å"It could be some kind of warning,† Elena proposed. â€Å"We don't know enough yet. We'l go to the station, we'l meet Alaric and Celia, and then†¦Ã¢â‚¬  â€Å"Then?† prompted Meredith, meeting Elena's cool blue eyes. â€Å"Then we'l do whatever we have to do,† Elena said. â€Å"As usual.† Bonnie was stil complaining when they got to the train station. It was impossible to stop worrying, though. Stefan had seen many things in his five hundred years of existence: vampires, werewolves, demons, ghosts, angels, witches, al sorts of beings who preyed on or influenced humans in ways most people could never even imagine. And, as a vampire, he knew a lot about blood. More than he had cared to admit. He'd seen Meredith's eyes flick toward him with suspicion when Bonnie began to bleed. She was right to be wary of him: How could they trust him when his basic nature was to kil them? Blood was the essence of life; it was what kept a vampire going centuries after his natural life span should have ended. Blood was the central ingredient in many spel s both benevolent and wicked. Blood had Powers of its own, Powers that were difficult and dangerous to harness. But Stefan had never seen blood behave in the way it had on Bonnie's arm today. A thought struck him. â€Å"Elena,† he said, turning to face her. â€Å"Hmmm?† she answered distractedly, shading her eyes as she peered down the track. â€Å"You said the rose was just lying there waiting for you on the porch when you opened the door this morning?† Elena brushed her hair out of her eyes. â€Å"Actual y, no. He was so used to depending on the connection between them that he kept forgetting it was gone now; he could sense Elena's emotions, could feel her aura, but they could no longer communicate telepathical y. He and Elena were separate again. Stefan hunched his shoulders miserably against the breeze. Bonnie frowned, the summer wind whipping her strawberry ringlets around her face. â€Å"Is Tyler even a werewolf now? Because if Sue's alive, he didn't kil her to become a werewolf, right?† Elena held her palms to the sky. â€Å"I don't know. He's gone, anyway, and I'm not sorry. Even before he was a werewolf, he was a real jerk. Remember what a bul y he was at school? And how he was always drinking out of that hip flask and hitting on us? But I'm pretty sure Caleb's just a regular guy. I'd have known if there was something wrong with him.† Stefan looked at her. â€Å"You've got wonderful instincts about people,† he said careful y. â€Å"But are you sure you're not relying on senses you don't have anymore to tel you what Caleb is?† He thought of how the Guardians had painful y clipped Elena's Wings and destroyed her Powers, the Powers she and her friends only half-understood. Elena looked taken aback and was opening her mouth to reply when the train chugged into the station, preventing further discussion. Only a few people were disembarking at the Fel ‘s Church station, and Stefan soon spotted Alaric's familiar form. After stepping down to the platform, Alaric reached back to steady a slender African-American woman as she exited behind him. Dr. Celia Connor was certainly lovely – Stefan would give her that. She was tiny, as smal as Bonnie, with dark skin and close-cropped hair. The smile she gave Alaric as she took his arm was charming and slightly puckish. She had large brown eyes and a long, elegant neck. Stylish but practical in designer clothing, she wore soft leather boots, skinny jeans, and a sapphire-toned silk shirt. A long, diaphanous scarf was wrapped around her neck, adding to her sophisticated demeanor. When Alaric, al tousled sandy hair and boyish grin, whispered familiarly in her ear, Stefan felt Meredith tense. She looked like she'd like nothing better than to try out a few of her martial arts moves on a certain gorgeous forensic anthropologist. But then Alaric spotted Meredith, dashed over, and took her in his arms, pul ing her off her feet as he swung her into a hug, and she visibly relaxed. In a few moments, they were both laughing and talking, and they didn't seem to be able to stop touching each other, as if they needed to reassure themselves that they were actual y together again at last. Clearly, Stefan thought, any worries Meredith had had about Alaric and Dr. Connor had been groundless, at least as far as Alaric was concerned. Stefan turned his attention to Celia Connor again. His first wary tendrils of Power discovered a slight simmering resentment emanating from the anthropologist. Understandable: She was human, she was quite young despite her poise and her many professional achievements, and she had spent a great deal of time working closely with the very attractive Alaric. It wouldn't be surprising if she felt a bit proprietary toward him, and here he was being pul ed away from her and into the orbit of a teenage girl. But more important, his Power found no supernatural shadow hanging about her and no answering Power in her. Whatever the meaning of the name Celia written in blood, it seemed Dr. Celia Connor hadn't caused it. â€Å"Somebody take pictures!† Bonnie cal ed, laughing. â€Å"We haven't seen Alaric for months. We have to document his return!† Matt got out his phone and took a couple of pictures of Alaric and Meredith, their arms around each other. â€Å"Al of us!† Bonnie insisted. â€Å"You too, Dr. Connor. Let's stand in front of the train – it's a terrific backdrop. You take this one, Matt, and then I'l take some with you in them.† They shuffled into various positions: bumping, excusing, introducing themselves to Celia Connor, throwing their arms around one another in a casual y exuberant style. Stefan found himself pushed to the edge, Elena's arm through his, and he discreetly inhaled the clean, sweet scent of her hair. â€Å"Al aboard!† the conductor cal ed, and the train doors closed. Celia's diaphanous scarf had somehow been firmly caught by the closing door of the train, and now the train was pul ing her along by the neck. She was running to keep from being strangled, the scarf like a leash yanking her along. And the train was beginning to pick up speed. Her hands pul ed at the scarf, but both ends were caught in the door, and her tugging only seemed to tighten it around her neck. Celia was approaching the end of the platform and the train was chugging faster. It was a flat drop from the platform to the scrub ground beyond. In a few moments, she would fal , her neck would be broken, and the train would drag her along for miles. Stefan took al this in within the space of a single breath and sprang into action. He felt his canines lengthen as a surge of Power went through him. And then he took off, faster than any human, faster than the train, and sped toward her. With one quick motion, he took her in his arms, relieving the pressure around her throat, and tore the scarf in half. He stopped and put Celia down as the train sped up and left the station. The remnants of the scarf slipped from around her neck and fluttered onto the platform by her feet. She and Stefan stared at each other, breathing hard. Behind them, he could hear the others shouting, their feet pounding on the platform as they ran toward them. Celia's dark brown eyes were wide and fil ed with tears of pain. She licked her lips nervously and took several short, gasping breaths, pressing her hands against her chest. He could hear her heart pounding, her blood rushing through her system, and he concentrated on pul ing his canines back and resuming his human face. She staggered suddenly, and Stefan slipped his arm around her. â€Å"It's okay,† he said. â€Å"You're al right now.† Celia gave a short, slightly hysterical laugh and wiped at her eyes. Then she stood upright, straightening her shoulders, and inhaled deeply.
